I've long said that Tulsi is one of the (if not the only) sane Democrat out there. She has left the Democratic party because she has recognized that they have gone crazy. I was disappointed when she didn't come down against the Trump impeachment because she had doubts. I was disappointed because:

1) In the American system, all doubt goes in favor of the accused.

2) If you want to be POTUS you have to make a decision. You don't get to sit it out. Anyway, great clip above.,

Justice Neil Gorsuch Says What Needs To Be Said

 Some of you all may be wondering why I never sued my former employer over my firing over the Trump shot. The reason was that I saw that the courts were in on the blatant disregard of the law and if they were to find in my favor they would also be indicting themselves. This is because they too had imposed such burdens on their employees. Ye olde t"wo wolves and a sheep debate what's for dinner" situation.

 With that said let's look at what Gorsuch has said

:

"the Court took a serious misstep when it effectively allowed nonparties to this case to manip- ulate our docket to prolong an emergency decree designed for one crisis in order to address an entirely different one."

 The nice thing here is that Gorsuch discusses the abuse of emergency decrees.

Since March 2020, we may have experienced the greatest intrusions on civil liberties in the peacetime history of this country. Executive officials across the country issued emer- gency decrees on a breathtaking scale. Governors and local leaders imposed lockdown orders forcing people to remain in their homes.13 They shuttered businesses and schools, public and private.14 They closed churches even as they al- lowed casinos and other favored businesses to carry on.15 They threatened violators not just with civil penalties but with criminal sanctions too.1

 I noted the way the states acted to criminalize things like walking down the street and not wearing a face diaper. It was quite revealing to see so called "black leaders' like Ras Baraka and Eric Adams have black people arrested for "being outside" and supporting medical segregation.

Federal executive officials entered the act too. Not just with emergency immigration decrees. They deployed a public-health agency to regulate landlord-tenant relations nationwide.19 They used a workplace-safety agency to issue a vaccination mandate for most working Americans.20

An absolute abuse of power as well as a usurpation of power that had no constitutional basis.

Not So Sanctuary

I thought that “sanctuary city” was a moral and financial good. For years Democrats have boldly stated that “immigrants are welcome here” as they declared places they run as “sanctuary cities” and ‘Sanctuary states”. This reference echos back to fugitive slave laws of the past (and perhaps things like the underground railroad) where those fleeing the persecution of the law could be sheltered by those who opposed those laws. As usual this emotional blackmail covers the fact that the two eras and circumstances are nothing alike.

Most of us who have a clue object to the ideas that the government should be:

1) Undermining the immigration law passed by the duly elected representatives on the country.
2) Using the taxes raised [by force] off of citizens that should be going to the benefit of said citizens, on persons who should not even be in the country.

The Dems response to that is:

You’re a racist for saying that.

I’m sure Barbara Jordan would agree.

So long as illegal aliens were invading southern states, mostly northern states, and their urban mayors could not resist painting the leadership in those locations, so long as they were Republicans, as racist, white supremacists for opposing said invasion. They went so far as to misrepresent border patrol agents on horseback as literal “crackers” in their successful attempt to oust Trump from the White House. Now that the border states and Florida, have sent the illegal aliens to various blue states, the Democrats running those places are singing a brand new tune.

I said at the time that when Trump got into office, one of his highest priorities should have been prosecuting each and every city, including the officials, who declared themselves sanctuary cities. It is a federal crime to aide and abet illegal aliens to enter or stay in the country. That includes providing the means to stay in the country.

1907. TITLE 8, U.S.C. 1324(A) OFFENSES

“Title 8, U.S.C. § 1324(a) defines several distinct offenses related to aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic transportation of unauthorized aliens, concealing or harboring unauthorized aliens, encouraging or inducing unauthorized aliens to enter the United States, and engaging in a conspiracy or aiding and abetting any of the preceding acts. Subsection 1324(a)(2) prohibits bringing or attempting to bring unauthorized aliens to the United States in any manner whatsoever, even at a designated port of entry. Subsection 1324(a)(3).”

and

“Harboring -- Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.”

So by openly declaring “sanctuary cities” these jurisdictions admitted to breaking federal law and since it was a group of them then it is a corrupt organization and RICO charges should be applied.
Of course Trump was (and is) all bark and no bite on these things failed to do this. Sessions thought it better to spend his time defending confiscation of peoples money (and other properties) for crimes they had not been charged with, much less convicted of. 

In the case of NY, the people who declared their intention to break federal law, put their names to the documented conspiracy:

Ain’t no passport check at the GWB, Lincoln or Holland tunnels.

When the dollar ceases to be THE currency with which to do international trade, the demand for it goes down which means it loses value both abroad *and at home*.

Chicago Loses A COVID Case

 

Well the good part about this is:

An Illinois judge ruled that the city of Chicago must rehire and pay back lost wages of unionized city employees who were fired or disciplined for violating COVID-19 vaccination requirements.

Administrative law judge Anna Hamburg-Gal, writing on behalf of the Illinois Labor Relations Board, said that the city "failed and refused" to bargain in good faith with union leaders "over the effects of its decision to implement a COVID-19 vaccine mandate."

And

Affected employees must also be paid back lost wages and benefits with 7% annual interest, according to the ruling.

The part that I have a problem with is the whole 

" the city "failed and refused" to bargain in good faith with union leaders ""

As I argued when I was put under the gun, Under what contract does a Union have to negotiate and prescribe medical care for its members?  Unions negotiate health benefits not actual health care.

My second problem is the fundamental of people being free to agree to and decline medical interventions without any sort of coercion. In particular the right to refuse EXPERIMENTAL medical treatments of any kind without coercion by any public or private entity.

This is THE fundamental issue and it is clear to me that these judges are not interested in this. I think this is because these judges are enforcing the interests of the state as it grows it's power over people in ways that it should never have. The entire "process violation" rulings are just distractions. The fundamental issue needs to be addressed or this WILL happen again.

CNN and the NewSpeak

As the power of the Tranny lobby grows and the CEI index continues to dictate to various corporations, the newspeak of Orwellian fame continues apace. I have long said and will continue to say that those who oppose the new religion must not use the newspeak or validate it in any way. This example is from CNN (not surprising eh?).

Just looking at the headline we see where CNNs interests lie. An alternate, and much more truthful headline would have been:

Kansas lawmakers override governor's veto to enact pro-woman sports law.

Note that this framing would have put the actual purpose of the law: to protect women in women's sports from men, front and center. Instead CNN shows that in it's world men competing in women's sports, as long as they claim to be a woman, is normal and expected and being against that is The Bad Thing(tm).

So the first lesson here is that whenever you see "anti-trans" you should replace that with "pro-women". In conversation always correct this.

 "Transgender women and girls in Kansas will no longer be allowed to compete on sports teams from kindergarten through college consistent with their gender, after state lawmakers on Wednesday overrode a veto from their governor to enact the restriction."

Again with the newspeak. By identifying males as "transgender women and girls" is again CNN pushing the nonsense. Men have never been allowed to compete in women's sporting events. Using the  New Euphemism(tm) changes nothing. What the law does is make that known fact explicit. Unfortunately such nonsense laws have to be passed because of these militant trannies who will do anything, including murdering children, to get everyone else to affirm their delusion.

Yes, murder children. Know exactly what you're dealing with.

Everyone knows that women's sporting events is not a "gender" in the way CNN is trying to position it. This is the "gender is not sex" argument that the left has successfully used as a wedge to separate people from the fact that 99.9% of the time gender *equals* sex. Everyone knows that women's sports exists precisely because women get trounced when they compete against men and therefore would NEVER win  any sporting competition where men are allowed.

" “It won’t increase any test scores. It won’t help any kids read or write. It won’t help any teachers prepare our kids for the real world. Here’s what this bill would actually do: harm the mental health of our students,” she said."

She can say whatever she wants to. The students who are not trannies are fine mentally. The trannies are sick in the head and they need professional help rather than being allowed to ruin women's sports.

Advocates of such measures have argued that transgender women and girls have physical advantages ​over cisgender women and girls in sports. But a 2017 report in the journal Sports Medicine that reviewed several related studies found “no direct or consistent research” on trans people having an athletic advantage over their cisgender peers, and critics say this legislation adds to the discrimination that trans people face, particularly trans youth.

 The above is an example of why I no longer trust academia and medicine. During COVID we saw that journals actually published junk reports with specific political purposes (ie: kill alternatives to any supposed "vaccine" so that EUAs could be granted). For sport, there is no need for "consistent research". All you need to do is look at the olympic games. Any and all of them. Women  are consistently outperformed by their male teammates. In many cases the slowest male athelete in an event is *faster* than the slowest female in an event. If you need any other proof look below:

Every time some goofball talks about there is no advantage, you show them this clip. It is a known tactic in this race for slower teams to put a male in with the women in order to see if they can get an advantage.

So any so called "scientific journal" that says that it finds no advantage to males is absolute junk and should be shut down and any references to it in any paper ought to be stricken.

Last week, Kentucky’s legislature overrode its Democratic governor’s veto of a bill that places bans on gender-affirming care for minors, on discussions of sexual orientation or gender identity in school, and on transgender students using bathrooms that align with their gender identity. The move comes after state lawmakers last year overrode another veto by the governor to enact its own anti-trans sports ban.

There is no such thing as "gender-affirming care".  Do not ever use this term. Any time someone uses this term you should say: :" you mean double mastectomies" and castration". And don't say it like your asking a question. It's a fact, state it as such. "gender affirming care" is another euphemism used to lull the public into complacency. It sounds "caring". It sounds "reasonable". It is not. Call it what it is.

I cannot believe I've lived long enough to see liberals go from condemning FGM in Africa and Arabia (that's female genital mutilation which involves the removal of the clitoris and in some cases, sewing the entrance to the vagina shut with only enough space to allow for urination and menstrual flow), to promoting double mastectomies, FGM and MGM for minors.

CNN has let you know where they stand. They are onboard and their use of the newspeak shows it.

The Public Money Tree

 Over the past few weeks I have been reading about the various schemes in NY and NYC to deal with the purported  MTA budgetary problems.  This in addition to the Federal government bailing out failing banks and other schemes. Up to now I had not really taken the concept of small government as seriously as I perhaps should have. COVID changed a lot of that thinking. Better late than never I suppose.

To summarize, NYC, supposedly following London's lead, wants to implement 'Congestion Pricing" in order to support the MTA. 

Think about that.

The scheme is that in order to go into Manhattan below 59th street (allowing exception for those trying to get to the Queens Bridge for the time being), vehicles would be charged EZ PASS style. This money would supposedly be used to close the budget of the MTA.

Think about that.

I've driven in Manhattan and trust and believe that 99% of people who find themselves below 59th street and not down there to gawk at the skyline and take a pleasure cruise. They are usually trying to conduct some kind of business. At least during the day. Usually when I go to NYC, I will either park in Harlem and take the train downtown OR I will park in lower east side and take the train north. I do whatever I can to avoid driving IN mid Manhattan.

So I pay a huge toll to enter NYC. Pay to use the mass transit when I get there. And now they want to ding me when I exit the FDR if I go to lower Manhattan to park. All so I can conduct business. Let's not even discuss what happens if you DO drive into mid-town. You almost certainly have to pay to park. So you get dinged with a huge toll. Then you get dinged for entering Manhattan below 59th street. Then you get dinged to park. Anyone who has paid for daytime parking in Manhattan knows how much THAT can hurt.

All that and you still have not conducted your business.

In some cases all of these dings can add up to about 100 bucks. You do realize there is a tax on that off street parking right? 

All for the privilege of what? Shopping in Manhattan? Eating in their restaurants. Really?

Anyway, that's not the gripe I have. Really. If you're dumb enough or wealthy enough to not care about that tax on your activity and keep spending money in Manhattan when there are alternatives, you go do that. Personally, I'm willing to bypass Manhattan entirely for Long Island. However; the gripe here is the stated mission: To close MTA budgets.

Why are drivers being asked to foot the bill for a service they may not use while having to pay for the services they DO use? If I don't ride the train, I shouldn't have to pay a fare. People who ride the trains aren't expected to pay my toll. If the MTA and/or government is short on funds then why doesn't it rearrange it's finances, including jettisoning things it has subscribed to (translation: programs) in order to pay for the MTA shortfall since it is so dire?

Why not raise the fare on the trains and busses to what would be sustainable. Perhaps people have gotten to used to artificially low prices for public transport and if they actually had to pay what it costs, like drivers have to when they use their vehicles?

How about the MTA get serious about fare beaters on its trains and busses and stop with this racial justice nonsense and poverty nonsense. I grew up poor and didn't fare beat. Ever.

The reason NYS does this is because it views the population as one big money tree. Why be responsible when we can dig into the pockets of the people. 

Money to house illegal aliens who shouldn't be here? More taxes for you buddy.

MTA can't keep within it's budget? More taxes for you buddy.

Even the 'speed cameras" that are all over the city now are taxes. They claim that they reduce accidents and fatalities. I doubt that. I've seen places where they are located. And many of them, it is impossible to DO the speed limit during the day much less go over it. Of course they have that covered as well.

On one egregious example of "more taxes for you buddy" is a speed camera placed on a 4 lane street that runs parallel to and feeds a highway of similar width. The camera was put near a school but that area is usually unused and not populated by students. I know, I attended that school. The area where students DO congregate? No camera. The coup-de-grace was that they dropped the speed limit on this road in order to drive up the amount of speeding tickets since going the previous limit now put you in fine territory.

I've heard of such nonsense in Staten Island as well.

This isn't just a NY thing. California implemented a "Mansion Tax" and is (or is considering) taxing people who have left the state. The federal government has a pending budget in which Biden wants to make a new "tax on the wealthy" to, you know, "make them pay their fair share". Almost everybody accepts this idea of :paying for their fair share" without even asking why the government deserves any of the money in the first place.

How much money has gone to Ukraine? How much to Israel? Yeah I said it. If we have money to hand out to countries and people in this country who do not belong here, then why do any taxes need to be raised?

Back to NY though. Did you know they recently voted on some new Diversity Department(tm). You know who gets to pay for that right? Question: If you have a debt do you take on new expenses? No? Government doesn't work that way. Why? Because you are the perpetual money tree. Nice roots you have there Shame it you got ringed.

Here Comes "Fed Coin"

 I haven't said much about the recent bank failures. Yes, failureS for those not paying attention. But the word on the street is Fed Coin is coming

The system will allow bill payments, money transfers such as paychecks and disbursements from the government, as well as a host of other consumer activities to move more rapidly and at lower cost, according to the program’s goals.

You do realize that your credit card and debit card do the same thing. It's not like they found a new way to move electrons faster. So no, it's not going to be faster. The only reason why there is a pause between a charge and it clearing your account is due to the clearing house middle men.

So the claims here have nothing to do with speed or cost.

"Institutions that participate in the program will have seven-day, 24-hour access, as opposed to a system currently in place that closes on weekends."

 Does your credit card or debit card stop working on weekends?

Some Fed officials say the program even could supplant the need for a central bank digital currency.

So it will walk like a duck, quack like a duck and look like a duck but we'll call it something else.

Trespassing The Shaman Pt 2

 In my last post about The Shaman I stipulated that the case against him rested upon whether he knew he wasn't allowed on the property. Trespassing requires that the person know they are not to be on a location. This was the argument used successfully to convict the men who shot Arbery in Georgia. I said:

Well that is a valid question. We know that in certain areas and certain points protestors were *let into the building*. I do not know if Shaman was a part of the crowd that met police resistance or if he was one of those who was let in.

 

Well know the Washington Post has released video showing that The Shaman was a part of a group who overran Capital Police:

As you can see, the police were keeping people from entering. The crowd overran the "blockade' and stormed the building. Shaman was in that initial crowd. Hence; it cannot be said that he wasn't aware of not being allowed in.  Because of this, it doesn't matter that he was shown around the building. He was still trespassing. 

Now you could argue that after entering he was made to believe he was not trespassing. That would be a lift for his defense attorneys. So far I have not seen any evidence of such a claim.  Certainly a trespass can be recinded at any time by the property owner or agent thereof. So it's not beyond reasonable doubt that after his clear trespass he came to the belief that it was "OK" for him to remain on premises. To that end the ball is and was in his lawyer's court to find those officers, depose them and find out if they did indeed give Shaman the impression that he was no longer considered trespassed.

All that said, I still do not think his 4 year sentance is anywhere near appropriate and I would argue it is a clear violation of the "cruel and unusual punishment" prohibition in the US Constitution.

How Dare They Buy Cars!

 I read this piece on the ridiculous rent increases happening in Kingston NY. I was struck by the comments of one of the landlords:

“My tenants are driving Teslas, BMWs, Volvo XC90s,” he says. “I’m driving a 20-plus-year-old Jeep with 400,000 miles.” And while he concedes the price of apartments “might be a hardship” for some renters, “if you’re a relatively young and mobile person, I don’t think it’s a big deal.”

 Your tenants are driving BMWs? How is that any of your business? Secondly that implies that this landlord thinks he should have the care note money rather than BMW AG. 

That's a lot of nerve.  I personally own 2 BMWs. I have lived FAR below my means for most of my life. I COULD pay far more in rent than I do and live elsewhere, particularly the high rises that are near me but WHY should I?

Why should I give some landlord 50% or more of my income?

This is why I don't get why people live in NYC with the ridiculous rents there. Why people shack up with 2,3, 4 people in order to "afford" rent. 

It is some huge sense of entitlement to look at what people have and think 'They should be paying me instead."

Not sure how that's only a 26m profit but OK. That's double the layout from 2019.

Exactly what's the justification for a 15-30% rent increase with resale values like that?

Look. Let's take rent at $1000 a month for easy math. If every unit is rented (doesn't happen but again, easy math) then the owner is getting $267,000 each month and $3.2 million each year.

That's not profitable? OK. Then how did they purchase the units in the first place? Where did THAT money come from? A loan you say? Fine, what was the collateral?  You think a bank lent them the money without seeing that these people run a profitable venture elsewhere?

Sure repairs and maintenance costs money. I've watched enough flip shows to know that those kinds of layouts, when done professionally and properly last for years and that money is well recouped.

$24/Hour Min Pay?

 I was pretty shocked when I read this:

$24/hour minimum for delivery work?

Really?

that's a $50k a year job before taxes working an 8 hour day, 5 days a week. For totally *unskilled* labour.

Really?

I didn't make that on my first job (many decades ago) and I was *skilled* labour.

If totally *unskilled* labour is to cost $50k/year who in their right mind who has skills is accepting anything close to that?

A heckler named Octavio López, who identified himself as a delivery worker of more than 10 years, derailed the event, shouting down leaders and casting blame on them for not securing a higher minimum pay rate casting them as “farsantes” – phonies.

“I wanted $30 an hour, too,” he said at one point, in Spanish. “You all lied to us.”

This man wanted $60k/year before taxes to do deliveries? 

Really?

And who is doing deliveries for 10 years for a business they don't own?

I'm a mean mofo. If that kind of demand came at me from the government, I'd check my bank account and then I'd shut my business down the next day and enjoy retirement. You ant $60k/ year you go to HVAC or Auto-mechanic school and pick up a skilled trade.

On the flip side:

Workers have long maintained they toil punishingly long shifts for what amounts to very little pay. One worker who spoke with THE CITY last year said she earned as little as $45 in take-home pay after a 10-hour shift.

First: Is this person an illegal alien?

Second: $45 for a 10 hour shift is $4.50/hr. That's not even minimum wage. Again, is this an illegal alien?
If this is NOT an illegal alien did they not look at the math of what they signed up for to realize they would be making $4.50 an hour? 

Lastly, why is a city government in a so called capitalist country setting wages for various industries? Nobody has to work delivery. Certainly not for $4.50/hr. If these places/companies cannot afford to break off minimum wage to their delivery people then their business model is all wrong and/or they are a vampire middle-man that needs to be eliminated.
 

Tresspassing The Shaman

 I saw the video on Tucker showing the Capitol Police "escorting" The Shaman around the Capitol building. I saw the commentary that said that the video was exculpatory and I read statements from the DC police saying that it generally was not. What follows are a few thoughts about how it could possibly be a tresspass.

If you recall when Arbery was shot in Georgia that people went out of their way to point out that Arbery could NOT have been trespassing because nobody told him that he was not allowed in the property. Due to that, any attempts to seize him amounted to kidnapping. 

With that in mind we have to ask the DC police if they ever *told* Shaman that he was trespassing. If he was never informed that he was to leave [now] then it can be argued, just like in the case of Arbery that he was NOT trespassing. Indeed if he was not told AND he was "escorted" around the building as the video showed, then he committed no crime and should never have been arrested, tried and imprisoned. 

This is settled law. Ask any card counter and they will tell you that a trespass has not happened unless you've been told/asked to leave. 

"Ahh..." you say. "How did he get into the building?" 

Well that is a valid question. We know that in certain areas and certain points protestors were *let into the building*. I do not know if Shaman was a part of the crowd that met police resistance or if he was one of those who was let in. If he was a part of the latter, it *cannot* be argued that he knew that he was "trespassing". Remember that the Capitol is a pubic building. While some areas may be "off limits" access to the building is *not* closed to the public. There are regular protests and confrontations with members of congress. Therefore, the mere presence of a person in that building is *not* evidence of a crime.

With this in mind, a fair jury could have very well found Shaman not-guilty since by law they are supposed to weigh any doubt *in favor of the defendant*.

Alternately the situation could have been that Shaman entered the building in one of the waves that was let in. As he and others were wandering about trying to find the chambers, he ran across some other police. Hypothetically they said to him something along the lines of:

"You can't be in here."

If that happened then Shaman was obliged to leave. The Capitol Police are empowered agents and can declare a person trespassing. If Shaman said anything to the effect of "I'm not going anywhere" then at that moment he is trespassing. It doesn't matter if he was shown around the building. He was asked to leave by an appointed agent and refused. 

That doesn't make him a violent insurrectionist.

It makes him liable for a misdemeanor trespass prosecution. That is all.

Again, going back to the card counter comparison. If the counter is asked to leave (trespassed) they don't have the option to say "well I'mma play the slot machines on the other side of the casino first..."

The last alternative (assuming he didn't breech barriers) is that he was wandering around, again looking for the chambers and encountered the police we see in the video. If they never said anything to the effect of "you can't be here, please leave now", then Shaman has no reason to believe he is trespassing and legally is not. Again, as established by law, you cannot be trespassing unless you have been informed you cannot be in a location.

If those police failed to "trespass" Shaman AND "escorted" him around, de-escalation technique or not, then there is no crime, the video is 100% exculpatory, Shaman should be freed immediately and sue for malicious prosecution and possible Civil Rights violations. If that video wasn't turned over to his lawyer and a jury was unable to view it, I believe there are criminal penalties in play.

So those are the possible scenarios I gather from the video. There are significant bits of information missing to make any one of them THE explanation. If any reader has that information please send along.

Time To Deploy The New Variant

 I lot of people caught flack for calling the Pandemic the "Plandemic". It would seem that they were more correct than we knew.

I'll admit that when I saw the screenshots of the messages I thought that no way this isn't fake. I mean who would be dumb enough to lay the plan out in a retrievable message?

Matt Hancock wanted to “deploy” a new Covid variant to “frighten the pants off” the public and ensure they complied with lockdown, leaked messages seen by The Telegraph have revealed.

The Lockdown Files – more than 100,000 WhatsApp messages sent between ministers, officials and others – show how the Government used scare tactics to force compliance and push through lockdowns.

The comment suggested that they believed the strain could be helpful in preparing the ground for a future lockdown and tougher restrictions in the run-up to Christmas 2020.

Mr Hancock then replied: “We frighten the pants off everyone with the new strain.”

Mr Poole agreed, saying: “Yep that’s what will get proper bahviour [sic] change.”

 "The proper bahavior change."

So when we say that the entire event was a means to get the masses "under control" it was not a conspiracy theory. 

The larger looming question is the "when do we deploy the new variant" question.

Exactly how would this person know about a "new variant" and why would he be under the impression that the government (or whatever agent) could and would release it upon receiving orders?

Recall that when Omicron came out many observers said that it was so differnent that it was highly unlikely to have been a "natural mutation". 

What did they know and when did they know it?
